FedEx Settles ADA Failure-to-Accommodate Case for $3.3M
A federal district court in Pennsylvania has approved a $3.3 million settlement between FedEx Ground and the EEOC. The settlement resolves a lawsuit alleging the employer failed to accommodate workers with hearing impairments, in violation of the Americans with Disabilities Act (ADA).
The lawsuit, which was filed in 2014, alleged that the employer discriminated against deaf and hard-of-hearing individuals who applied for or worked in package handler positions. It was alleged that FedEx failed to provide accommodations for job application procedures, workplace communications and meeting participation.
According to the EEOC’s release, 229 individuals may share the monetary settlement. The agreement also requires FedEx Ground to make changes to accommodate individuals who are deaf or hard of hearing.
